How Investing vs Trading impacts tax

In most cases of buying and selling cryptocurrency as a retail investor, you are participating in investing rather than trading. The two are treated differently for tax purposes.

  • Investing is subject to capital gains tax or income tax, depending on the nature of the transaction.
  • Trading in this case refers to self-employment which is subject to income tax and National Insurance Contributions.

The key difference between investing and trading – along with the different tax treatments, is how losses generated in the crypto-activity can be used.

In their guidance, HMRC have explicitly stated that they would expect it to be exceedingly rare that any crypto-activity constituting buying & selling crypto would be classified as “trading”.

If you are uncertain, speak to a tax advisor as there are always exceptions, including but not limited to, developing tokens and large scale mining.

How is crypto tax calculated in the United States?

You can be liable for both capital gains and income tax depending on the type of cryptocurrency transaction, and your individual circumstances. For example, you might need to pay capital gains on profits from buying and selling cryptocurrency, or pay income tax on interest earned when holding crypto.

Do You Pay Tax on Shares If You Don't Sell?

Holding shares that have risen in value does not create a tax bill in Australia. Here is why unrealised gains are not taxed, and what still is.

Key takeaways
This tax guide is regularly updated: Last Update

It is one of the most common questions from new investors: if my shares are up but I have not sold, do I owe tax? In Australia, the short answer is no, with one important exception.

Unrealised gains are not taxed

Capital gains tax only applies when you dispose of shares. A holding that has doubled on paper is an unrealised gain, and the ATO does not tax it until you actually sell, transfer or gift the shares. You could hold for a decade and never trigger CGT if you never dispose.

Dividends are the exception

While the growth is untaxed until you sell, any dividends you receive along the way are assessable income in the year you receive them, even if you reinvest them. So a buy-and-hold investor with no sales can still have a tax obligation from dividends.

Why records still matter

Even though you are not taxed yet, the cost base you set today decides the size of the gain when you eventually sell. Good records now save money later.

Track it from day one

Summ records the cost base of every parcel and every dividend as you go, so the numbers are ready whenever you decide to sell.
